Direct appeals

A direct appeal challenges legal errors in the trial or sentence. Specifically, it is based on the record: transcripts, motions and rulings. New evidence is generally not considered.

Deadlines are short. For example, in federal criminal cases, the notice of appeal is generally due within 14 days of judgment. Many states allow around 30 days. Consequently, missing the deadline can end the right to appeal.

Post-conviction relief

Post-conviction relief, by contrast, addresses problems outside the trial record. The most common claim is ineffective assistance of counsel. Under Strickland v. Washington, you must show your lawyer's performance was deficient and that it affected the outcome.
