DUI Lawyer in Illinois — Statutory Summary Suspension, Supervision and Aggravated DUI

By the American Counsel legal team · Updated October 2026

An Illinois DUI arrest triggers an automatic license suspension and a criminal case. A DUI lawyer in Illinois helps you challenge the suspension, explore court supervision and avoid the long-term consequences of a conviction.

Illinois offers some options other states do not. For example, many first offenders can receive court supervision, which is not a conviction if completed. However, repeat offenses carry severe penalties. Therefore, early strategy matters.

Our attorneys prepare suspension petitions, DUI defense packs and mitigation packets for cases across Illinois, from Cook County to downstate.

Illinois DUI law basics

Illinois' DUI law is 625 ILCS 5/11-501. You can be charged for a BAC of 0.08 or more, or for being under the influence of alcohol, drugs or cannabis to a degree that makes you incapable of driving safely.

Most first and second DUIs are Class A misdemeanors. However, certain circumstances create aggravated DUI, which is a felony. Examples include a third or subsequent DUI, driving without a valid license or insurance, or causing great bodily harm.

Statutory summary suspension

After a DUI arrest with a failed or refused test, Illinois imposes a statutory summary suspension. It takes effect on the 46th day after notice. For a first offender, a failed test usually means six months, while a refusal usually means twelve months.

You can file a petition to rescind the suspension. It must generally be filed within 90 days of notice. The hearing examines whether there were reasonable grounds for the arrest and whether proper warnings and testing were given. Consequently, it is a valuable early opportunity.

Our license hearing service prepares the petition and arguments.

MDDP and BAIID

Many first offenders can drive during the suspension with a Monitoring Device Driving Permit. It requires a breath alcohol ignition interlock device. As a result, you can often keep driving to work.

Court supervision for first offenders

Illinois allows court supervision for a first DUI in many cases. If you complete the conditions, the case is dismissed without a conviction. However, supervision is available only once in a lifetime for DUI.

Supervision is not available in some situations, such as when a child was injured or when the person had a prior supervision. Furthermore, it still appears on your driving record. Our DUI Defense Pack reviews whether supervision is realistic.

Illinois DUI penalties

Penalty ranges change and depend on the facts, so treat the figures here as a general guide and confirm them for your case.

A first DUI conviction can bring up to a year in jail, fines and license revocation. However, many first offenders receive supervision instead.

A second DUI typically brings mandatory jail or community service and a longer revocation. Meanwhile, a third DUI is generally a Class 2 felony. Consequently, prior offenses matter a great deal.

Reinstatement through the Secretary of State

After revocation, reinstatement requires a hearing with the Illinois Secretary of State. You must show you are not a danger, often with an alcohol evaluation and treatment records. Our license reinstatement service prepares for these hearings.

Defenses in Illinois DUI cases

Defenses often challenge the stop, the arrest and the testing. For example, breath tests require proper observation periods and maintained instruments. Similarly, cannabis DUI cases raise difficult questions about impairment.

Video evidence is also important. Squad car and booking videos can contradict reports. Therefore, request them early.

Mitigation and Illinois courts

If a conviction is likely, mitigation matters. Completing an alcohol evaluation, treatment and a risk education program helps. Our DUI Mitigation Packet and character letters services prepare these materials.

In Cook County, DUI cases are heard in Chicago and at suburban district courthouses. Meanwhile, collar and downstate counties hear cases at their county courthouses. For more, read our national guide to multiple-offense and felony DUI.

A typical Illinois DUI timeline

First, the arrest and notice of summary suspension happen together. Next, the suspension begins on the 46th day, unless rescinded. Meanwhile, you have 90 days to file a petition to rescind.

After that, the criminal case moves through court dates, discovery and negotiations. In addition, completing an evaluation and treatment early strengthens your position. Finally, the case ends in supervision, a plea, dismissal or trial. Consequently, acting in the first weeks gives you the most options.

The true cost of an Illinois DUI

Fines are only part of the cost. In addition, expect court costs, an alcohol evaluation, risk education or treatment, BAIID installation and monthly monitoring fees. Moreover, insurance premiums usually rise sharply, and an SR-22 filing is often required. Consequently, a fixed-fee defense pack is a small investment compared with the long-term cost of a conviction.
