I-9 basics every employer must follow
Employees complete Section 1 no later than their first day of work. Employers complete Section 2 within three business days of the start date, after examining acceptable documents.
Employers must not specify which documents an employee presents. Doing so can be discriminatory. Furthermore, forms must be kept for three years after the hire date or one year after employment ends, whichever is later.
Remote verification
Employers enrolled in E-Verify may use an alternative remote document examination procedure, if they follow its requirements. Others must examine documents physically. Consequently, check which method you are allowed to use.
Common I-9 mistakes
Errors are common. Missing signatures, blank fields, late completion and incorrect document entries top the list. In addition, employers often forget to reverify expiring work authorization.
Over-documentation is another risk. Asking for more or different documents than required can lead to discrimination claims. Meanwhile, keeping copies of documents for some employees but not others can create problems too. A consistent compliance policy prevents this.
ICE Notices of Inspection
ICE begins an audit by serving a Notice of Inspection. Employers usually have three business days to produce their I-9s. That is not much time. Consequently, a well-organized file is essential.
After review, ICE may issue a notice of technical violations, which gives a chance to correct them. More serious violations can lead to fines. Knowingly employing unauthorized workers carries heavier penalties.
