In Ohio, drunk driving is called OVI: operating a vehicle while impaired. This guide from an OVI lawyer in Ohio perspective explains the administrative suspension, the penalties and when an OVI becomes a felony.
Ohio suspends your license at the time of arrest if you fail or refuse a test. Moreover, high-test OVIs carry heavier penalties. Therefore, early action matters.
Our attorneys prepare OVI defense packs, suspension appeal materials and mitigation for cases across Ohio.
Ohio OVI basics
Ohio's OVI law is Ohio Revised Code § 4511.19. You can be charged for a BAC of 0.08 or more, or for being impaired by alcohol or drugs. In addition, a BAC of 0.17 or more is a "high-test" OVI with heavier penalties.
Penalty ranges change and depend on the facts, so treat the figures here as a general guide and confirm them for your case.
First-offense penalties
A first OVI typically brings three days in jail or a 72-hour driver intervention program, a fine and a license suspension. High-test first offenses bring more jail time and restricted "party plates" if driving privileges are granted.
The administrative license suspension
If you fail or refuse a chemical test, Ohio imposes an administrative license suspension, or ALS, immediately. For a first failed test, the ALS is typically 90 days. For a first refusal, it is typically one year.
You can appeal the ALS, usually at or within a set period after your initial court appearance. Moreover, limited driving privileges may be available after a waiting period. Our license hearing service prepares the appeal.
Repeat and felony OVI
Ohio looks back ten years for most repeat OVI sentencing. A second or third OVI brings mandatory jail, longer suspensions and immobilization or forfeiture of the vehicle in some cases.
A fourth OVI within ten years, or a sixth within twenty years, is generally a felony. Furthermore, anyone with a prior felony OVI faces a felony on any later OVI. Our felony DUI consultation reviews how priors are counted.
Yellow plates and interlocks
Ohio may require restricted "party plates" for certain OVI offenders who receive driving privileges. These yellow plates signal that the driver has an OVI.
Similarly, ignition interlocks are required in some cases, especially repeat and high-test OVIs. Consequently, plan for these costs and restrictions.
Defenses in Ohio OVI cases
Every impaired-driving case has potential weak points. First, the traffic stop needs reasonable suspicion. Second, the arrest needs probable cause. Third, chemical tests must follow strict procedures.
For example, breath instruments must be properly maintained and calibrated, and operators must follow observation periods. Similarly, blood samples require proper collection, storage and chain of custody. Field sobriety tests can be affected by weather, footwear, injuries and medical conditions.
Test timing and substantial compliance
Ohio requires breath and blood tests to be performed in substantial compliance with Department of Health regulations. Consequently, procedural errors can lead to suppression of results.
Video is often decisive. Dashcam, bodycam and booking footage may contradict the written report. Therefore, request it early. Our DUI Defense Pack reviews the stop, the tests and the procedures, starting at $199.
The true cost of an impaired-driving conviction in Ohio
Fines are only part of the cost. In addition, expect court costs, alcohol education or treatment, ignition interlock fees where required, and reinstatement fees. Moreover, insurance premiums usually rise sharply, and an SR-22 filing is often required.
There are hidden costs too. For example, a conviction can affect jobs that require driving, professional licenses and immigration status. Commercial drivers face strict rules: a 0.04 limit in commercial vehicles and, usually, at least a one-year CDL disqualification for an offense in any vehicle.
Consequently, a fixed-fee defense pack is a small investment compared with the long-term cost of a conviction. If a conviction is likely, our DUI Mitigation Packet and character letters services help the court see the full picture. Afterwards, our license reinstatement service explains the steps back to driving. For more, read our national guide to multiple-offense and felony DUI.
What to do in the first week after a Ohio OVI arrest
The first week matters most. First, write down everything you remember about the stop, the tests and the arrest, while it is fresh. Next, keep every piece of paperwork the officer gave you, especially any license notice.
Then act on the license deadline. In Ohio, that means you should raise any appeal of the administrative license suspension at or soon after your initial appearance. Missing it can cost your license automatically. Meanwhile, ask whether limited driving privileges are available after the waiting period.
Finally, avoid discussing the case on social media or with anyone except your attorney. Consequently, you protect both your license and your defense from the start.
A typical Ohio OVI case timeline
Every case is different, but most follow a similar path. First, the arrest and license notice happen on the same day. Next, the license deadline runs in the first days or weeks.
After that, the criminal case begins in municipal or county court for most misdemeanor OVIs, and the Court of Common Pleas for felonies. Discovery, including test records and video, is requested. Then negotiations, motions or trial follow over several weeks or months.
Finally, the case ends in a dismissal, a reduced charge, a diversion outcome where available, a plea or a verdict. As a result, early organization shapes every later step.
