Someone you loved has died, and you have been named executor. Suddenly you face court forms, creditors and deadlines. A probate administration lawyer helps you handle each step correctly, so you can settle the estate without personal risk.
Probate is the court process for paying debts and transferring a person's assets. It applies to assets held in the deceased person's name alone without a beneficiary designation. However, many estates qualify for simpler procedures. Therefore, the first step is finding out which process applies.
This guide walks through probate from start to finish and explains the fixed-fee documents that support each stage.
Do you need probate at all?
Not every estate needs full probate. For example, assets held in a living trust, joint accounts with survivorship and accounts with beneficiary designations usually pass outside probate.
Furthermore, most states offer a simplified process for small estates. A small estate affidavit lets heirs collect assets without a court case if the total is below a state limit. Our Small Estate Affidavit service starts at $59.
Consequently, an early review can save months. A probate consultation checks which assets need probate and which do not.
Opening the estate
If probate is needed, the executor files a petition with the probate court. Usually, the original will is filed too. The court then appoints the executor, often by issuing letters testamentary. If there is no will, an administrator is appointed instead.
Some states allow independent administration with little court supervision. Texas is a well-known example. Others require more court involvement. As a result, the workload depends heavily on your state.
Our Probate Documents service prepares the petition and appointment papers. Additionally, our executor documents service covers notices and record-keeping.
Creditors and inventory
Next, the executor notifies creditors. Many states require publishing a notice and mailing notice to known creditors. Creditors then have a limited time to file claims. Our Notice to Creditors service prepares those notices.
Meanwhile, the executor gathers and values the assets. Most courts require a formal inventory. Our Inventory of Assets service organizes accounts, property and valuations into the required format.
Executor duties
Executors owe fiduciary duties. Therefore, keep estate money separate, keep records and avoid self-dealing. Paying heirs before creditors can create personal liability.
Closing the estate
Once claims are resolved and taxes filed, the executor distributes the remaining assets. Many courts require a final accounting showing all money in and out. Then the executor asks the court to approve distribution and close the estate.
Our Petition for Final Distribution service prepares that request. As a result, the executor can be discharged properly.
If heirs dispute the will, the process can become contested. A will contest consultation explains the options. To avoid probate for your own estate, read our guide to living trusts.
